Compliance with Anti-Child Pornography Laws (Philippines)

1. The Customer acknowledges and agrees that its use of the internet services provided by Lumen shall at all times comply with (Philippines) Republic Act No. 11930, also known as the Anti-Online Sexual Abuse or Exploitation of Children (OSAEC) and Anti-Child Sexual Abuse or Exploitation Materials (CSAEM) Act of 2022 (the "Act") and any implementing rules and regulations issued thereunder, as may be amended from time to time.

 

The Customer specifically warrants that it shall not use the internet services to:

i) Access, host, transmit, disseminate, or otherwise make available any content that constitutes Online Sexual Abuse or Exploitation of Children (OSAEC) or Child Sexual Abuse or Exploitation Materials (CSAEM) as defined under the Act.

ii) Engage in any activity that facilitates or promotes OSAEC or the creation, distribution, or access to CSAEM.

 

2. The Customer understands and agrees that Lumen is obligated under the Act to, among other things, immediately block access to, remove, or take down internet addresses, URLs, websites, or any content containing CSAEM or involving streaming or live-streaming of OSAEC within twenty-four (24) hours from receipt of a notice from a competent authority.

 

3. Lumen reserves the right to take any necessary action, including but not limited to suspension or termination of services, upon becoming aware of any actual or suspected violation of this clause or the Act by the Customer, without prejudice to any legal remedies available to Lumen or the relevant authorities. The Customer agrees to indemnify and hold Lumen harmless from any claims, damages, liabilities, costs, and expenses arising out of or in connection with any breach of this clause or the Customer's violation of the Act.
