処理についての詳細およびLumenプライバシーデータシート

 

お客さまが選択および注文したサービスの種類、場所、数量、設定、機能、期間、および同様の詳細は、プライバシーおよびデータ保護法に基づいて要求される範囲内で、Lumenへの処理命令を規定するものとします。オンラインポータルおよび同様の機能を介して行われるお客さまのセルフサービス活動、お客さまの指示に基づく移動/追加/変更などのアクション、および処理に影響を与える製品やサービスの同様の利用は、同様にLumenへの処理命令を規定するものとします。


Lumenの製品およびサービスを利用することによって処理される個人情報を含む情報、当該サービスの利用による当該情報の処理の可否とその期間、サービス利用拠点に基づく処理の実施場所、お客さまのデータのセキュリティ保護を強化するために、Lumenの製品およびサービスを構成するか、製品およびサービスを追加購入するかどうかは、お客さまが決定します。製品およびサービスについては、通常、以下の詳細が適用されます。

A. 対象物。処理の対象物は、お客さまが製品およびサービスを介して処理することを選択した個人情報です。

 

B. 期間。Lumenが実施する処理の期間は、お客さまが適宜、注文、指示、あるいは開始した、対象となる製品およびサービスに適用されるサービス期間であり、該当する注文書および/または作業明細書で規定されている場合があります。

 

C. 性質。Lumenが実施する処理の性質は、契約書および該当する注文書および/または作業明細書に記載されているように、伝送、コンピューティング、ストレージ、またはその他同様の情報テクノロジーインフラストラクチャーサービス、ならびに該当する製品およびサービスをお客さまにご利用いただくことによって実施可能となる処理活動です。

 

D. 目的。Lumenが実施する処理の目的は、該当する製品およびサービスをお客さまに提供することです。

 

E. 個人情報の種類。Lumenが処理する個人情報の種類はお客さまによって決定され、お客さまが製品およびサービスを利用することで処理することを選択したあらゆる種類の個人情報が対象となります。

 

F. データ主体の分類。Lumenが個人情報を処理できるデータ主体の分類はお客さまによって決定され、お客さまが製品およびサービスを利用することで処理することを選択したあらゆる分類のデータ主体が対象となります。

下記のプライバシーデータシートへのリンクがある製品およびサービスについて、Lumenでは、該当の製品およびサービスの提供期間中に、Lumenが特定のエンドユーザーの個人情報にアクセスまたは処理する可能性がある場合、処理に関する詳細情報を追加提供します。これらの処理の詳細は、Lumenとお客さまの間の契約で対象となっている該当サービスに関する説明および注文内容を補足するものであり、詳細の変更に伴って更新されます。

お客さまのエンドユーザーのトラフィックデータのみを処理するLumenの製品

欧州連合の「電子通信分野における個人データの処理およびプライバシーの保護に関する 2002年7月12日の欧州議会および理事会2002/58/ECの指令（ePrivacy指令）、第2条（b）」では、トラフィックデータを、電子通信ネットワーク上での通信の伝達またはその請求を目的として処理されるあらゆるデータと定義しています。

下記のLumen製品では、Lumenのお客さまにサービスを提供する過程で、お客さまのエンドユーザーに関連するトラフィックデータのみが処理されます。

お客さまのエンドユーザーのトラフィックデータを処理しないLumenの製品

特定の製品について、Lumenは、2000年6月8日の欧州議会および欧州理事会の指令2000/31/EC（電子商取引に関する指令2000）の第12条に基づく通信の「単なる導管」として機能しています。サービスプロバイダが以下の場合、サービスプロバイダのサービスは単なる導管として見なされます。

（a）送信を開始しない、

（b）送信の受信者を選択しない、および

（c）送信に含まれる情報を選択または変更しない。

 

Lumen製品の多くは、サービスを提供する過程においてお客様のエンドユーザーの個人情報を処理しません。

A.  Subject Matter.  The subject matter of the processing is the personal information the customer elects to process via the products and services.


B.  Duration.  The duration of the processing undertaken by Lumen is the service term applicable to the relevant products and services as ordered, instructed, or otherwise initiated by the customer from time‑to‑time and as may be set forth on the applicable order forms and/or statements of work.


C.  Nature.  The nature of the processing undertaken by Lumen is the transmission, computing, storage or other similar information technology infrastructure services and processing activities available through the customer’s use of the applicable products and services and as further described in the agreement and relevant order forms and/or statements of work.


D.  Purpose.  The purpose of the processing undertaken by Lumen is the provision of the applicable products and services to the customer.


E.  Type of Personal information.  The type of personal information processed by Lumen is determined by the customer and includes any type of personal information the customer elects to process through the customer’s use of the products and services.


F.  Categories of Data Subjects.  The categories of data subjects whose personal information may be processed by Lumen is determined by the customer and includes any categories of data subjects the customer elects to process through the customer’s use of the products and services.

For the products and services with links to Privacy Data Sheets displayed below, Lumen provides additional processing details where Lumen may access or process specific end user personal information while providing the products and services.  These processing details supplement the applicable service descriptions and orders included in the agreement between Lumen and the customer and will be updated as details change.

Lumen Products Only Processing Customer End User Traffic Data

The European Union’s Directive 2002/58/EC of 12 July 2002 concerning the processing of personal data and the protection of privacy in the electronic communications sector (the ePrivacy Directive), Article 2 (b) defines Traffic Data as: any data processed for the purpose of the conveyance of a communication on an electronic communications network or the billing thereof. 

The Lumen products listed below process only Traffic Data associated with the customer’s end users, in the course of providing service to Lumen’s customer.

Lumen Products Not Processing Customer End User Traffic Data

For certain products, Lumen is acting as a “mere conduit” of traffic under Article 12 of Directive 2000/31/EC of the European Parliament and of the Council of 8 June 2000 (the Electronic Commerce Directive 2000). A service provider’s service qualifies as a mere conduit, if the service provider:

(a) does not initiate the transmission;

(b) does not select the receiver of the transmission; and

(c) does not select or modify the information contained in the transmission.


Many Lumen products do not process Customer end user personal information in the course of providing service.
